U.S. Court in Tennessee Won’t Nix Whistleblower Action Against Hospital Alleging Overlapping Surgery Non-Compliance

Chattanooga-Hamilton County Hospital Systems, d/b/a Erlanger Medical Center and Erlanger Health System (Erlanger), cannot escape a whistleblower action alleging it violated the False Claims Act (FCA) by billing Medicare for overlapping surgeries where medical residents were not sufficiently supervised by teaching physicians, a federal court in Tennessee held January 19.
