U.S. Court in Illinois Finds Whistleblower Showed FCA Materiality in Drug Pricing Fraud Action Against SuperValu

A federal court in Illinois found September 30 that two whistleblowers sufficiently showed materiality in their action under the False Claims Act (FCA) alleging grocery store chain SuperValu Inc. submitted false claims to the government by reporting their “retail” price for certain drugs as the “usual and customary” price even though many customers paid much less through its price-match program.
