Second Circuit Nixes Whistleblower Action Against Oncology Provider Under Public Disclosure Bar

The False Claims Act’s (FCA’s) public disclosure provision barred a whistleblower action against U.S. Oncology, Inc. alleging it submitted false reimbursement claims to Medicare and Medicaid that were tainted by kickbacks, the Second Circuit held March 28 in affirming dismissal of the fourth amended complaint.
