OIG Issues Unfavorable Advisory Opinion for Joint Venture with Surgeon Owners

An arrangement in which an entity would assist surgeons with the formation and operation of a turnkey physician-owned entity that would perform intraoperative neuromonitoring (IONM) services would generate prohibited remuneration under the Anti-Kickback Statute (AKS), if the requisite intent were present, which would constitute grounds for the imposition of sanctions, the Department of Health and Human Services Office of Inspector General (OIG) said in an advisory opinion posted August 18.
