Methodist Hospitals of Dallas’ most qualified applicant policy did not violate the Americans with Disabilities (ADA) on its face where the hospital refused to reassign an employee who was disabled to a vacant position that she could perform in favor of a more qualified applicant, the Fifth Circuit held March 17.
