DME Manufacturer Agrees to $2.5 Million Settlement of Kickback Allegations

Durable medical equipment manufacturer Phillips Respironics agreed to a $2,471,359.25 settlement to resolve allegations that it gave kickbacks to sleep laboratories, U.S. Attorney for the Southern District of California Tara McGrath announced December 22, 2023.

The settlement resolves allegations that from 2016 through 2021, Philips RS North America LLC f/k/a Philips Respironics, Inc. provided sleep labs with free masks used to treat and diagnose sleep-related respiratory disorders to induce the labs’ physicians to write referrals or prescriptions for Respironics-brand masks that suppliers would fill and bill to federal health care programs, a press release said.

The settlement resolves allegations only, and there has been no determination of liability.
