The federal government must prove "but for" causation to carry the day on its allegations that Regeneron Pharmaceuticals, Inc. violated the Anti-Kickback Statute (AKS) by improperly funneling millions of dollars to a Chronic Disease Fund (CDF) to subsidize patient copays for its drug Eylea, the Fifth Circuit held February 18 in the closely watched case.
