Proposed Rule on Mental Health Parity Is a Major Expansion of Federal Regulation of Managed Care

To increase compliance with requirements that insurers offer benefits for mental health and substance use disorder (MH/SUD) treatments in parity with those for medical and surgical (M/S) treatment, on July 25, 2023, the federal government proposed regulations and guidance to the Mental Health Parity and Addiction Equity Act (MHPAEA) that would, among other new requirements, impose additional restrictions on issuers’ medical management techniques and require plans and issuers to collect and evaluate network adequacy data and provider reimbursement rates in order to enforce equitable access to providers of MH/SUD services compared to providers of M/S services.
