Hospital Proposal for Nurses to Perform Certain Care Duties Instead of Physicians Wouldn’t Violate AKS, OIG Says

An arrangement under which a hospital would utilize its employed nurse practitioners (NPs) to assist in rendering certain care to patients of participating physicians who are inpatients or in observation status in two designated medical units would not violate the federal Anti-Kickback Statute (AKS), the Department of Health and Human Services Office of Inspector General (OIG) said in an advisory opinion posted December 19.
