U.S. Court in New Hampshire Says Patient Boarding Was Unlawful Seizure of Hospital Emergency Departments

The New Hampshire Department of Health and Human Services Commissioner violated a group of hospitals’ Fourth Amendment rights by boarding patients deemed to be in need of emergency mental health treatment in their emergency departments when state-run facilities lacked capacity to accept the patients, the U.S. District Court for the District of New Hampshire held February 23.
