New York Enacts Law to Require Advance Notice for Certain Health Care Transactions

On May 3, 2023, the New York governor signed the state budget for fiscal year 2023-2024, enacting legislation that includes a requirement for certain health care entities to provide 30 days’ pre-closing notice to the New York State Department of Health (DOH) in connection with material transactions that have revenue thresholds of $25 million or more. The notice requirement applies to transactions that close August 1, 2023, or 90 days after the enactment of the legislation.
