Fifth Circuit Tosses Emergency Care Physicians’ Lawsuits Against Insurers

A lawsuit brought by emergency care physicians against insurers for failing to reimburse the providers their “usual and customary rate” for out-of-network services must be dismissed, the Fifth Circuit held February 16 after the Texas Supreme Court held the state’s “Emergency Care Statute” did not authorize a private cause of action.
